1. Use of Website
This website is provided for informational and promotional purposes related to custom portrait artwork and related services. You agree not to use this site for any unlawful purpose or in a way that could impair its operation.
2. Intellectual Property
All content on this website, including artwork, images, videos, graphics, text, and design, is the exclusive property of The Portrait Art and may not be copied, reproduced, or distributed without written permission.
3. Commissioned Artwork
Each commissioned portrait is a unique, hand-drawn work created by the artist. By submitting a request or photo through our form, you acknowledge:
Deposits (if applicable) are non-refundable once work has begun.
The artist retains the right to display completed works for portfolio and promotional purposes unless otherwise agreed in writing.
4. Limitation of Liability
We make every effort to ensure accuracy of information on this site but make no guarantees regarding availability, pricing, or completion times. We are not liable for any indirect, incidental, or consequential damages arising from your use of this website or any commissioned work.

Our site may contain links to third-party websites. We are not responsible for their content, policies, or practices.

These terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles.

Privacy Policy

This policy describes how ThePortraitArt handles information when you browse this website or contact Victor Sun about a portrait.
Information you provide
The inquiry form asks for your name, email address and message. You may also provide a phone number, your preferred portrait package, the occasion and whether you are commissioning personally or for a real estate client. The form accepts text. Reference photographs can follow by email; the form does not take payments.
Your inquiry and correspondence
An accepted inquiry is saved in the website's private inquiry records before an email notification is attempted. This helps Victor recover your request if the notification fails. Victor uses your details to discuss your idea, prepare a quote and communicate about your commission. Hosting and email providers process information needed to deliver these services.
Form protection
When you use the form, the inquiry system uses your IP address to limit repeated requests. It stores protected codes derived from that address and request counts in short-lived limit records, rather than storing the address itself in those records. Hosting and security services may separately log your IP address and request information.
The form uses Google's reCAPTCHA service and other checks to help prevent automated and abusive submissions. reCAPTCHA can use cookies and information about your browser and interaction with the website. Google's Privacy Policy and Terms of Service apply.
Films, analytics and advertising measurement
Film previews use YouTube images. Playing a film loads the YouTube player and connects your browser to that service.
The website also uses Google measurement tools to understand visits and advertising performance. These services can receive page-view and event information, browser or device information, and online identifiers such as cookies. The Meta advertising choice below does not control these separate Google services.
Advertising measurement choices
We use Meta advertising measurement under the notice beside our inquiry form and in the website footer, unless you opt out. No checkbox or acceptance click is required to send an inquiry. Once this notice is provided, Meta can receive information about the public pages you visit, browser or device information, and advertising identifiers associated with your browser or an ad you clicked. We use this information to measure and improve our advertising. A passive notice is recorded separately from an affirmative permission choice.
If you then send an inquiry and book a commission, we may connect that inquiry to the confirmed deposit and send Meta a purchase event with the agreed commission value. We use your original inquiry email in hashed form and permitted advertising identifiers to help Meta match the purchase with the person who made the inquiry. Hashing changes the email's format; it does not make the information anonymous. We do not send your message, photographs, private commission notes or a different payer's contact details as advertising data.
You can opt out using the link beside the notice, or use “Privacy choices” in the footer. Opting out stops future Meta measurement from this browser and future advertising sharing for inquiries linked to its saved preference. We also honor your browser's Global Privacy Control signal. Existing opt-outs are not replaced by a passive notice. Your inquiry and commission work either way, and opting out does not delete the inquiry, quote or payment records needed to handle your commission. If you use another browser or have cleared its saved preferences, email contact@theportraitart.com so Victor can opt out the relevant inquiry. Information already sent to Meta is not recalled by this website's preference control.
Measurement permissions last up to 90 days. After that, measurement may resume under the notice shown on a later visit, unless you previously opted out or send Global Privacy Control. An opt-out remains effective for linked inquiries and for a browser we can still recognize from its saved preference. Clearing cookies can remove that browser recognition. Permitted advertising visit details are kept in this browser for up to seven days and can be saved with an inquiry you submit. Those periods do not guarantee that Meta will attribute a commission to an advertisement.
When we agree on a commission, private website records may also include the agreed price, deposit, payment request details, confirmed payment references and payment status. Payment is handled through PayPal; this website does not collect your card number. A payment request can be addressed to a different email when agreed with you. That billing contact does not replace the original inquiry's advertising identity.

Retention and removal
Accepted inquiries remain in Victor's private inquiry records until their personal details are deliberately removed. Email correspondence and backup copies are kept separately and require separate handling when a removal request is processed.
After an inquiry's personal details are removed, a limited record remains: its reference, delivery history and protected verification codes derived from the original submission and its identifier. These codes help prevent an old retry from recreating the inquiry. A request whose notification is still in progress may require delivery review before removal can finish.
The inquiry system records rejection categories without retaining rejected message text in those diagnostics. These diagnostics are limited to seven days and 500 entries, and expired submission-limit records are cleared routinely. Hosting, security and other service providers may maintain their own operational logs.
Access and requests
Connections to this website use HTTPS. Website inquiry records require authorized administrative access.
To request a copy, correction or removal of your inquiry information, email contact@theportraitart.com. Victor will verify the request before acting and review any relevant email or backup copies separately.
